Terms and Conditions

1. Scope

The following Terms and Conditions apply to all orders placed through our online shop at buydigitalstuff.com.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.

Our offers are directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB). We do not sell to traders, resellers or commercial buyers. By placing an order, the buyer confirms that they are acting as a consumer. We reserve the right to refuse orders and to withdraw from contracts already concluded if it becomes apparent that the buyer is acting as a trader or that the digital content is intended for resale.

Our offers consist exclusively of digital content that is not supplied on a tangible medium (e.g. product keys, access credentials, download links). No physical goods are shipped.

2. Contracting party, conclusion of the contract, correction options

2.1 Contracting party

The purchase contract is concluded with Simon Lederer, trading as “BuyDigitalStuff”, Zugspitzweg 18, 83533 Edling, Germany, email: support@buydigitalstuff.com, phone: +49 160 7768954.

2.2 Conclusion of the contract

The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

You can add products to the shopping cart and enter your email address, name, country and preferred payment method during checkout. You only enter a full billing address if you expressly request an invoice. Before placing the order, you consent to the immediate performance of the contract (see Section 7). By clicking the “Place order with obligation to pay” button, you submit a binding offer to purchase the products in your shopping cart.

Alternatively, you can order via express checkout with Apple Pay, Google Pay or PayPal on the product page. In this case we take your email address, name and country from the respective payment service, and, if you request an invoice there, also your billing address. Here too, you first consent to the immediate performance of the contract (see Section 7). By clicking the payment service's “Buy” button and confirming in the payment window that then appears, you submit a binding offer: on the product page to purchase the product selected there in a quantity of one, in the shopping cart and during checkout to purchase the products in your shopping cart.

The contract is concluded when we accept your offer by sending an order confirmation by email or by providing the digital content, whichever occurs first.

2.3 Correction options

All your details are displayed again before you place the order. In the shopping cart you can change quantities or remove products; you can correct your details during checkout using the respective edit buttons. You can also correct input errors by cancelling the checkout process.

With express checkout, the payment window of the respective service shows you the total amount and the details transmitted before you confirm. There you can change your details or cancel the process; in that case no order is placed.

3. Contract language, storage of the contract text

German and English are available as contract languages.

We store the contract text. After the contract has been concluded, we send you the order details, these Terms and Conditions, the withdrawal information and the model withdrawal form by email on a durable medium (Section 312f BGB). You can view these Terms and Conditions on this page at any time.

4. Provision of the digital content

The digital content we offer is not supplied on a tangible medium. There is no shipping of physical goods and no collection.

4.1 Method of provision

After receipt of payment, the content is provided automatically by email to the email address given during checkout, in the form of a product key, access credentials or a download link. Please make sure that your mailbox can receive messages and check your spam folder if necessary.

4.2 Provision of platform accounts

Where the subject of the contract is a newly created platform account (e.g. Steam), the provision includes, in addition to the original access credentials for the platform account, the access credentials for an email mailbox set up specifically for this account. This mailbox is provided by us on our own server infrastructure and serves exclusively for the initial access to and verification of the platform account. After the handover, the buyer is asked to change the access credentials and the email address stored in the platform account to their own details without delay, in order to ensure sole control over the account.

4.3 Delivery times and system requirements

The content is usually provided within 24 hours of receipt of payment. If a different delivery time applies, it is stated in the respective product description. The main characteristics of the digital content, its functionality including applicable technical protection measures, the system requirements, the required platform, the available language version and any regional restrictions (e.g. region lock, country restriction) are set out in the respective product description.

5. Prices and payment

All prices are final prices and include statutory VAT. There are no shipping costs.

Payments are processed by the payment service provider Stripe (Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland). The available payment methods are shown to you during checkout. Payments with Apple Pay, Google Pay and PayPal are also processed via Stripe; the terms of the respective service additionally apply to its use.

The digital content is provided after receipt or confirmation of payment.

6. Rights of use

The rights to use the digital content pass to you only upon full payment.

You receive a simple, non-exclusive right, unlimited in time, to use the purchased digital content privately. Reproduction, modification, making available to the public, rental or commercial transfer is not permitted.

Additional licence or usage terms of the respective manufacturer or platform operator remain unaffected and must be observed by you. Where necessary, we refer to such terms in the product description.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. For details, please refer to our withdrawal information.

For contracts for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires under the conditions of Section 356 (5) BGB. For this purpose, before you place the order we obtain your express consent to the start of performance before the end of the withdrawal period and your acknowledgement that you thereby lose your right of withdrawal, and we then send you the confirmation pursuant to Section 312f (3) BGB.

As we provide the digital content immediately after receipt of payment, an order in our online shop is only possible with this consent and acknowledgement.

8. Liability for defects and guarantees

The statutory provisions of Sections 327 et seq. BGB apply to the supply of digital products.

If a product key, access or download link provided does not work or does not correspond to the product description, please contact us at support@buydigitalstuff.com. After checking, we will provide you with a working replacement or refund the purchase price.

Information on any additional manufacturer guarantees and their exact conditions can be found with the respective product.

9. Liability

We are always liable without limitation for claims arising from damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the event of guarantee promises, if agreed, or
  • insofar as the scope of application of the German Product Liability Act applies.

In the event of a slightly negligent breach of material contractual obligations, that is, obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the contracting party may regularly rely (cardinal obligations), by us, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.

Otherwise, claims for damages are excluded.

10. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Protection of minors

We do not offer through this shop any digital content that, under the German Youth Protection Act, is subject to age restrictions and may only be supplied to persons aged 18 or over.

If an age rating applies to a digital content offered, it is stated in the product description. By placing an order, you confirm that you have reached the minimum age required.
